What is a Statute of Limitations<\/h1>\n

In both criminal<\/strong> and civil cases<\/strong> Statutes of Limitation<\/strong> must be observed.<\/h2>\n

A Statute of Limitation<\/strong> is a time period defined by statute or law<\/strong> which requires legal proceedings<\/strong> to be initiated within a certain time period.\u00a0 If the action is not initiated within the prescribed time period it will be barred, no recovery can be gained.\u00a0 For instance in criminal law<\/strong> the State of Tennessee must begin prosecution within so many years from the time that the crime was committed.\u00a0 Some crimes typically do not have a limitation period, such as homicide.<\/p>\n

Statutes of Limitations Differ Depending on Case<\/h3>\n

In civil law<\/strong> there are many different limitation periods depending on the type of type of law suit<\/strong>.\u00a0 For example a law suit<\/strong> for personal injury<\/strong> (auto accident, slip and fall, etc.) must be initiated within one (1) year from the date of the accident.\u00a0 Breach of contract<\/strong> cases have variable statutes of limitation<\/strong>s depending on the type of contract<\/strong>.\u00a0 Breach of contract includes collections on medical bills, credit cards, etc.<\/p>\n

If you have been injured<\/strong>, or someone owes you money<\/strong>, or otherwise breaches a contract<\/strong> consult with an attorney immediately<\/strong>.\u00a0 If a creditor is attempting to collect an old debt<\/strong> have an attorney review<\/strong> the debt and collection activity to determine if it outside the statute of limitations.<\/p>\n
