People often ask: Can we agree to no child support?<\/strong> or Can it be waived?<\/strong> Of course nothing in this post can replace the advice of an attorney. (review<\/a>) But, generally speaking, child support can not be waived, by agreement or otherwise.\u00a0 In Tennessee as well as other states child support is determined by law<\/strong>.\u00a0 The Tennessee Child Support Guidelines<\/strong> must be followed by the Court.\u00a0 The Court is given the ability to deviate (or vary) from the guidelines. \u00a0But, \u00a0this is rarely done. \u00a0Certainly not to the extent of “waiving” \u00a0support.\u00a0 The court must specifically find that a deviation or variance from the Child Support Guidelines<\/strong> is proper. \u00a0And that such deviation will still provide adequate support for the child<\/strong> or children.<\/p>\n A case in point: <\/strong>Attorney Jim Purple, represented a client (the mother) in a divorce action<\/strong>.\u00a0 The mother had a relatively low income in comparison to the father.
