Do it yourself Divorce<\/h1>\n

When you are getting divorced<\/strong>, should you have an attorney<\/strong>?<\/h2>\n

What if your spouse has an attorney to draft an “agreed<\/a>” divorce? \u00a0Or you and your spouse get a do it yourself divorce kit? \u00a0As with most legal issues, the answer to these questions is somewhat complicated? \"\"<\/a> In a typical divorce<\/strong> involving children child support<\/strong> is set based upon the Tennessee Child Support Guidelines<\/a>.\u00a0 One parent will carry health and dental insurance and both parents will pay their proportionate share of the premium. Uninsured health and dental costs including deductibles are typically split 50\/50 between the parents.\u00a0 If the children are to attend private school, then usually both parents will share in the financial burden. Be prepared to handle these and many more issues in a do it yourself divorce.<\/p>\n

But what if the divorce is not a typical one<\/strong>.\u00a0 Imagine this scenario: Your spouse hires an attorney to draft an agreed divorce. <\/strong>You\u00a0<\/strong>read the agreement and realize that you get virtually nothing but pay almost everything.\u00a0 The children will be spending equal time with both parents – 50\/50 parenting time and joint custody<\/a>. \u00a0You have to pay rehabilitative alimony<\/a> for five (5) years at $2500 per month plus almost $2,000 per month in child support<\/strong>.\u00a0 You also must maintain health insurance on the children.\u00a0<\/strong>\u00a0You pay all 100% of the uninsured medical and dental expenses<\/strong>.\u00a0 Additionally, you must pay 100% of the private school tuition<\/strong> and education expenses for the children.\u00a0 If this is not enough, you must also pay the mortgage on the marital home<\/strong> until it is sold.\u00a0\u00a0 Your spouse is not disabled, but in fact has a college education, and is fully capable of working.<\/p>\n

Why would anyone agree to this?<\/strong>\u00a0 In a do it yourself\u00a0divorce<\/strong>\u00a0without a\u00a0lawyer<\/strong>\u00a0a person is very prone to agreeing to something that is not desirable. \u00a0Nor likely to be ordered by the court. \u00a0 The above scenario could have turned out differently if each person had been represented\u00a0 by a divorce attorney<\/strong>.\u00a0 No doubt that any lawyer would have advised against such a one sided agreement<\/span>.\u00a0 Under certain circumstances a person\u00a0 may be required to pay both alimony and child support<\/strong>, and a portion of health insurance premiums and uninsured costs.\u00a0 But, when both parents are well educated and capable of being gainfully employed, then both should contribute financially to the support of the children<\/strong>.<\/p>\n

There are times when one attorney can and does draft an agreement which is fair and proper for both parties.<\/h3>\n
