{"id":1182,"date":"2011-07-17T09:17:04","date_gmt":"2011-07-17T13:17:04","guid":{"rendered":"http:\/\/purplelawfirm.com\/blog_news\/?p=1182"},"modified":"2011-07-17T09:17:04","modified_gmt":"2011-07-17T13:17:04","slug":"dui-in-tennessee-third-strike-and-your-out-for-5-years","status":"publish","type":"post","link":"https:\/\/purplelawfirm.com\/law-and-you-chattanooga\/2011\/07\/17\/dui-in-tennessee-third-strike-and-your-out-for-5-years\/","title":{"rendered":"DUI in Tennessee &#8211; Third Strike and Your Out for 5 Years"},"content":{"rendered":"<h1>DUI in Tennessee &#8211; Third Strike and Your Out for 5 Years<\/h1>\n<h2>Effective July 1, 2011, <strong>DUI offenders<\/strong> have it tougher.<\/h2>\n<p>&nbsp;<\/p>\n<figure id=\"attachment_1202\" class=\"wp-caption alignleft\" style=\"max-width: 150px\"><a href=\"https:\/\/purplelawfirm.com\/attorneys\/About_attorney_jim_purple.htm\"><img decoding=\"async\" class=\"size-thumbnail wp-image-1202\" title=\"Tennessee DUI laws\" src=\"https:\/\/purplelawfirm.com\/law-and-you-chattanooga\/wp-content\/uploads\/sites\/2\/2011\/07\/legal_scales1-150x150.png\" alt=\"Tennessee enacts tougher DUI laws and penalties\" width=\"150\" height=\"150\" \/><\/a><figcaption class=\"wp-caption-text\">Chattanooga DUI Defense Attorneys<\/figcaption><\/figure>\n<p>The State of <strong>Tennessee<\/strong> has not only <a title=\"Tennessee Pretrial Diversion Changes, No Diversion for DUI Offenses\" href=\"https:\/\/purplelawfirm.com\/law-and-you-chattanooga\/2011\/07\/04\/tennessee-pretrial-diversion-changes-no-diversion-for-dui-offenses\/\">removed DUI<\/a> from the list of <strong>criminal offenses<\/strong> eligible for <strong>judicial diversion<\/strong>, but have also toughened the penalties as well.\u00a0 Now if you are convicted of a <strong>third offense of DUI<\/strong> then you face a minimum of five (5) years suspension of driving privileges instead of three (3) years under former law.<\/p>\n<h3>More changes in Tennessee DUI laws<\/h3>\n<p>The new <strong>Tennessee law<\/strong> also removed an obstacle which prevented the court from issuing a <a title=\"New Requirements for DUI Restricted License\" href=\"https:\/\/purplelawfirm.com\/law-and-you-chattanooga\/2010\/12\/12\/new-requirements-for-dui-restricted-license\/\"><strong>restricted drivers license<\/strong><\/a> to a person who refused a <strong>breathalyzer test<\/strong> or <strong>blood test<\/strong> if the driver had not been advised of the consequences of refusal.\u00a0 In other words the court now has discretion to issue a restricted license under the &#8220;<strong>implied consent<\/strong>&#8221; law, even if the driver was not informed of the consequences of refusing either test.\u00a0 The court now also has the discretion to require such a driver to operate a vehicle with an <strong>ignition interlock device<\/strong>.<\/p>\n<p>[important]<strong>Tennessee Implied Consent<\/strong>: Under Tennessee law if you operate a motor vehicle on Tennessee roads or highways you are presumed to have consented to <strong>Blood Alcohol testing<\/strong> &#8211; either <strong>breathalyzer<\/strong> or blood test. Failure to submit to testing is a <strong>criminal<\/strong> offense which can result in <strong>suspension of drivers license<\/strong> and other penalties. [\/important]<\/p>\n<p>Tennessee&#8217;s <a title=\"Bail Changes for DUI Offenders in Tennessee\" href=\"https:\/\/purplelawfirm.com\/law-and-you-chattanooga\/2011\/02\/04\/bail-changes-for-dui-offenders-in-tennessee\/\">trend of tougher DUI legislation<\/a> is joined by Alabama which has proposed legislation which creates a criminal charge of <a title=\"Tougher DUI Laws\" href=\"http:\/\/www.dui-usa.drinkdriving.org\/duilaws\/dui-drunkdriving\/new-alabama-aggravated-dui-laws-tougher-penalties-introduced\/\">&#8220;Aggravated DUI&#8221;<\/a>, and <a title=\"Making it tougher for DUI defendants\" href=\"http:\/\/blog.thenewstribune.com\/politics\/2011\/05\/10\/governor-approves-tougher-dui-penalties\/\">Washington State<\/a> which passed tougher DUI laws to be effective in September 2011.
