Mr. O&#8217;Reilly asks &#8220;is the burden of proof too high? &#8221; and claims that <strong>Casey Anthony&#8217;s attorney<\/strong> did not raise reasonable doubt as a defense, implying that the jury should not have followed that line of thinking.\u00a0 Fortunately, whether or not a defense attorney &#8220;raises&#8221; reasonable doubt, the American system of justice requires criminal juries to convict if and only if the State has proved its case <a title=\"Casey Anthony \u2013 Beyond a Reasonable Doubt?\" href=\"https:\/\/purplelawfirm.com\/law-and-you-chattanooga\/2011\/07\/06\/casey-anthony-beyond-a-reasonable-doubt\/\">beyond a reasonable doubt<\/a>.\u00a0 The Judge is required to instruct the jury and charge the jury with this very duty.\u00a0 To fail to do so would be a violation of due process and <strong>Constitutional rights<\/strong> afforded by the Fourteenth Amendment resulting in reversible error. [important]<\/p>\n<p><a href=\"https:\/\/purplelawfirm.com\/law-and-you-chattanooga\/wp-content\/uploads\/sites\/2\/2011\/07\/legal_scales.png\"><img decoding=\"async\" class=\"aligncenter size-thumbnail wp-image-1175\" title=\"legal_scales\" src=\"https:\/\/purplelawfirm.com\/law-and-you-chattanooga\/wp-content\/uploads\/sites\/2\/2011\/07\/legal_scales-150x150.png\" alt=\"\" width=\"150\" height=\"150\" \/><\/a>&#8220;<strong>&#8230;nor shall any state deprive any person of life, liberty, or property, without due process of law.&#8221;<\/strong> [\/important]<\/p>\n<h2>Innocent People Could Be Convicted By the Media<\/h2>\n<p>Cases like the <strong>Caylee Anthony<\/strong> death are horrific, defying any description.\u00a0 But, if our system of justice makes an exception in cases like these, then you could be the next person <strong>charged with a crime and convicted<\/strong> because it looks like you are guilty.\u00a0 The police would be empowered to arrest you just because they <strong>believe you <em>may<\/em> have committed a crime<\/strong>, you <em>behave like a guilty person<\/em>.\u00a0 Is this the system we want?\u00a0 Just so a mom who looks like a partying lying &#8220;monster&#8221;.\u00a0 <strong>Should Casey Anthony be put to death because Bill O&#8217;Reilly and Nancy Grace thinks she is guilty?<\/strong><\/p>\n<p>Fortunately, whether Casey Anthony is innocent or not, our jury system worked- no one has to like the result, even the jurors.\u00a0 But, as<a title=\"Juror had to acquit Casey Anthony because its the law\" href=\"http:\/\/abcnews.go.com\/US\/casey_anthony_trial\/casey-anthony-juror-jury-sick-stomach-guilty-verdict\/story?id=14005609\"> juror number 3<\/a> has said\u00a0 you can not put someone to death if you can not even prove that the crime charged was even committed.\u00a0 The State of Florida, for whatever reason, failed to prove its case. Would anyone want to face the death penalty, be convicted and killed by lethal injection when the State can not even prove that a murder was committed? Or even <strong>face life in prison just because your behavior was bizarre and inexcusable<\/strong>?<\/p>\n<h3>Our System of Justice Must Remain in Line with the Constitution<\/h3>\n<p>No, our system of <strong>justice must remain in line with our Constitution<\/strong> to ensure that all who are charged with a crime are afforded a <strong>fair trial and due process of law<\/strong>.\u00a0 Else we risk becoming like the countries we decry for arresting and convicting, executing a person without a fair trial.
