What is a durable power of attorney?
A Durable General Power of Attorney is perhaps the most powerful legal document that can be written. In short, a power of attorney is a document that gives another person the absolute power and authority to sign anything that you can sign, to virtually do anything you can do yourself. In other words, a person who has your “power of attorney” (attorney-in-fact) acts in your place. Such a person actually signs your name and adds their signature with the phrase “under power of attorney.” An attorney-in-fact can sell your house, file a lawsuit in your name, apply for loans, credit cards, etc.
Giving someone your power of attorney is a very serious decision, so before you execute a durable general power of attorney, consult a lawyer.
