Choosing the Right Divorce Lawyer

With the stakes so high, how do you choose an attorney to represent you and protect your legal rights in a divorce?  What should you consider when choosing a divorce lawyer.

Cost Effective Alternatives in Tennessee Divorce

A divorce trial could be very costly and emotionally stressful.  An uncontested agreed or "no fault" divorce is an alternative which ought to be explored with your divorce attorney.  This helps you to end your marriage without an ugly battle

Another alternative to lengthy litigation is divorce mediation, where you and your spouse work with a certified mediator to resolve the issues and reach agreement, then your divorce lawyer can incorporate the mediation agreement into the Final Decree of Divorce as a Marital Dissolution Agreement.

Sometimes a less costly alternative to final divorce is a legal separation.   In a legal separation the marital assets are not typically divided in a final form, so there is less risk of losing value in the marital home, or retirement account.  It also is a simpler process which saves attorney fees, court costs, and/or mediation fees and does not end or dissolve the marital relationship.  Ask a divorce attorney about legal separation.

Should have a Divorce Attorney

When you are getting divorced, should you have an attorney?  What if your spouse has an attorney to draft an “agreed” divorce?  As with most legal issues, the answer to these questions is somewhat complicated and ought to be reviewed with a lawyer experienced in divorce and alimony issues.

The Process and Impact of Divorce

Ultimately most every aspect of your life will be impacted by divorce -after all you are dissolving and ending your marital relationship in its entirety. You will want and need a lawyer at your side that is experienced and caring. The process of divorce and the time that it takes to finalize  divorce is variable depending upon the individual circumstances of the marriage. In Tennessee there is a mandatory waiting period for divorce of 60 days without children and 90 days if you have a minor child born of the marriage - not applicable to step-children. If the divorce is uncontested and both husband and wife have agreed to a resolution of all issues then the divorce can be final almost immediately after the waiting period.  But if there are any matters unresolved then the case will proceed to a divorce trial of the issues that remain unsettled between the parties. This may take some time, and the trial is often preceded by written discovery requests (interrogatories and production of documents) and even a deposition of husband and wife, and perhaps other witnesses. If your divorce involves child custody the legal issues may need to be addressed not only in the divorce but also in subsequent court or mediation proceedings to change or modify child custody or child support.
